With Surety Bonds, Your Payment Is Guaranteed

A surety bond is like an insurance policy: The general contractor pays a "bonding company" to ensure that all subcontractors and material suppliers will receive payment in the event that the contractor's own money runs out.

For public jobs, the public entity will almost always require that the general contractor post a surety bond. For private jobs, it's less common.

Filing a "Stop Notice" — Another Way To Collect

If you're afraid that the general contractor won't pay you, just bypass him. A "stop notice" lets you go straight to the person who pays the general contractor. In a public job, that would be the owner. In a private job, it's the bank.

So if you're owed $100,000, you can file a stop notice with the bank that instructs them to withhold $125,000 — 125 percent of what you're owed — from the general contractor.

That money will be held in a trust until your dispute with the general contractor is settled, or until a judge decides who should receive the money.
